Welcome to Shape! These Terms of Service ("Terms") govern your access to and use of the Shape mobile application, as well as any related websites, features, content, and services that we provide in connection with the app (collectively, the "Service").

By creating an account or using Shape, you agree to these Terms. If you do not agree, please do not use our Service.

Shape is designed to help you share moments through photos and engage with your friends and people nearby. Our goal is to create a fun and interactive space where you can vote on images, express your opinions, and connect with others effortlessly.

1. Who Can Use Shape?

   To use Shape, you must:

   • Be at least 13 years old (or the minimum legal age in your country to use social media services). If you are under 18, you confirm that you have parental or guardian consent to use the app.

   • Have the legal capacity to enter into these Terms.

   • Not have been previously banned from using Shape.

   • Comply with all applicable laws when using our Service.

   All references to "you" and "your" in these Terms apply to both individual users and, where applicable, to those acting on behalf of a company, organization, or other entity. If you create an account on behalf of someone else, you confirm that you have the legal authority to do so.
   
   
   

2. Your Content & Rights You Grant Us

   When you post Content on Shape, you decide who can see it. There are three main ways to share:

   • Friends – Content shared in this mode is private and visible only to your approved friends.

   • Followers – Your Content is visible to people who follow you. They can interact with it, but it won’t appear outside their feed.

   • Explore – Content posted here is visible to users nearby based on your location settings and may appear in public feeds.

   2.1. Your Content

   • "Content" refers to any profile photos, photos, videos, emojis, captions, comments, messages, or other material shared through our Service.

   • You retain ownership of any Content you share on Shape.

   • You are responsible for ensuring your Content complies with applicable laws and does not infringe on others’ rights.

   • You may not post Content that is illegal, harmful, misleading, or otherwise violates these Terms.

   2.2. Rights You Grant Us In exchange for using our Services, you grant us a limited, non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to:

   • Display, distribute, and host your Content based on your chosen audience (Friends, Followers, or Explore).

   • Modify or adapt Content (e.g., resizing images for better display).

   • Use Content posted to Explore or Followers for promotional purposes within Shape (e.g., highlighting popular posts).

   This license ends when you delete your Content or account, except:

   • If your Content has been shared, saved, or interacted with by others, it may still be visible.

   • We may retain copies for backup, legal, or security purposes.

   2.3. Our Rights Regarding Your Content

   While we do not actively monitor or moderate content, we reserve the right to review, access, remove, or restrict content at any time for any reason, including:

   • Ensuring the smooth operation of our Services.

   • Investigating potential violations of these Terms or applicable laws.

   • Addressing content that may be reported by users or pose risks to the community.

   We may also assign badges or recognitions based on user activity and engagement within the app. These badges are awarded at our discretion and do not constitute any legal entitlement or claim.

   You are solely responsible for the Content you create, upload, post, send, or store through our Service, as well as for your interactions with other users. You must ensure that your Content and actions comply with applicable laws and regulations. Shape is not responsible for any disputes or legal consequences arising from your use of the Service.

4. Reporting Violative Content

   If you come across Content that violates these Terms, you can report it by contacting us at hello@appshape.io.

   We may review reported Content and take action at our discretion, but we are not obligated to monitor, remove, or respond to every report unless required by law.
   
   
   

5. License to Use Our Services

   We grant you a personal, non-exclusive, non-transferable, revocable, and limited license to access and use our Service for personal, non-commercial purposes, subject to these Terms.

   You may not:

   • Copy, modify, distribute, sell, or lease any part of our Service.

   • Reverse-engineer or attempt to extract the source code of our Service.

   • Use the Service for any unauthorized or illegal purposes.

   This license is automatically revoked if you violate these Terms. We reserve the right to suspend or terminate your access at any time.
   
   
   

6. Limitation of Liability
   
   

   • Shape is provided "as is" and "as available", without any express or implied warranties.

   • We do not guarantee that the Service will always be available, error-free, or uninterrupted.

   • To the maximum extent permitted by law, we are not responsible for:

   • Any loss of data, Content, or access to the Service.

   • Any harm resulting from interactions between users.

   • Any damages caused by third-party services, software failures, or unauthorized access to your account.

   • However, nothing in these Terms limits our liability where such limitation is not permitted by law, including in cases of gross negligence or where required by consumer protection laws.
     
     
     

7. Termination & Account Suspension

   We may suspend or terminate your access to Shape if:

   • You violate these Terms or any applicable laws.

   • We receive repeated reports about your activity.

   • You attempt to harm or disrupt the Service.

   If you wish to delete your account, you can do so in the app settings. Once deleted, your Content may no longer be recoverable, and we are not responsible for any data loss as a result of account deletion.
   
   
   

8. Changes to These Terms

   We may update these Terms from time to time. If we make significant changes, we will notify you through the Service or via email.

   By continuing to use Shape after the changes take effect, you agree to the updated Terms. If you do not agree with the new version, you should stop using the Service.
   
   
   

9. Governing Law & Jurisdiction

   These Terms are governed by the laws of Poland, without regard to its conflict of law principles.

   To the extent that these Terms allow for litigation in a court, both you and Shape consent to the exclusive jurisdiction of the courts of Poland. Any claims or disputes (whether contractual or otherwise) arising out of or relating to these Terms or your use of the Service will be litigated exclusively in Polish courts, unless this is prohibited by the laws of the country where you reside.

   If you are located in the European Economic Area (EEA), your rights under the General Data Protection Regulation (GDPR) and applicable national data protection laws also apply.

   If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
