Terms of service

Welcome to Shape! These Terms of Service ("Terms") govern your access to and use of the Shape mobile application, as well as any related websites, features, content, and services that we provide in connection with the app (collectively, the "Service").

By creating an account or using Shape, you agree to these Terms. If you do not agree, please do not use our Service.

Shape is designed to help you share moments through photos and engage with your friends and people nearby. Our goal is to create a fun and interactive space where you can vote on images, express your opinions, and connect with others effortlessly.

1. Who Can Use Shape?

   To use Shape, you must:

   • Be at least 13 years old (or the minimum legal age in your country to use social media services). If you are under 18, you confirm that you have parental or guardian consent to use the app.

   • Have the legal capacity to enter into these Terms.

   • Not have been previously banned from using Shape.

   • Comply with all applicable laws when using our Service.

   All references to "you" and "your" in these Terms apply to both individual users and, where applicable, to those acting on behalf of a company, organization, or other entity. If you create an account on behalf of someone else, you confirm that you have the legal authority to do so.
   
   
   

2. Your Content & Rights You Grant Us

   When you post Content on Shape, you decide how it is shared with other users. Within the Service, the following sharing options are available:

   • Friends – Content shared in this mode is private and visible only to your approved friends.

   • Followers – Content shared in this mode is visible to users who follow you and may be viewed within their feed. Content shared in this mode is considered public within the meaning of these Terms.

   • Explore – Content shared in this mode is public and may be shown to Shape users nearby, based on your location settings, as well as in public feeds within the Service.

   2.1. Your Content

   • “Content” means any materials you share through the Service, including in particular profile photos, photos, videos, captions, emojis, comments, messages, and other visual or textual content. “Content” also includes the manner in which such materials are presented within the application interface, provided that such presentation does not include additional personal data that is not publicly visible to other users of the Service.

   • You retain ownership of all Content you post on Shape.

   • You are responsible for ensuring that your Content complies with applicable laws and does not infringe the rights of third parties.

   • You may not post Content that is illegal, misleading, harmful, or otherwise violates these Terms.

   2.2. License Granted to Shape

   1. Private Content – Friends

      With respect to Content shared exclusively in Friends mode, you grant Shape a limited, non-exclusive, and royalty-free license solely to the extent necessary to provide the Service, including to:

      • display the Content to the audience you select,

      • store and process the Content for technical purposes,

      • adapt the Content to technical requirements of the application.

      Content shared in Friends mode is not used by Shape for marketing or promotional purposes outside the operation of the Service, unless you provide separate, explicit consent.

   2. Public Content – Explore and Followers

      With respect to Content shared in Explore or Followers mode, you grant Shape a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license, without time limitation, to:

      • use, copy, and reproduce the Content, including in the form of screenshots,

      • store, process, modify, or adapt the Content,

      • publish, distribute, and publicly display the Content,

      • use the Content for the promotion, advertising, and development of the Shape Service and the Shape brand. This license also includes the right to use the Content in the form of screenshots or other presentations of the application interface, which may include the username, profile photo, comments, reactions, badges, and other elements visible within the standard Content view in the Shape application.

      This license applies to the use of Content both within the Shape application and outside of it, including in:

      • social media platforms,

      • marketing and promotional materials,

      • advertisements,

      • websites,

      • application stores (including the App Store and Google Play).

      Your use of the Service constitutes sufficient compensation for granting the above license, and you are not entitled to any additional compensation or claims against Shape in this respect.

   2.3. Expiration of Content and License

   Deleting Content, automatic expiration of Content (e.g., after 24 hours), or deletion of your account does not affect the validity of the license granted to Shape with respect to public Content that has already been used or prepared for use, including Content used in marketing, promotional, or advertising materials, in accordance with these Terms.

   2.4. Our Rights Regarding Content

   While Shape does not actively monitor all Content, we reserve the right to review, access, remove, or restrict Content at any time where necessary to:

   • ensure proper operation of the Service,

   • investigate potential violations of these Terms or applicable laws,

   • respond to user reports or Content that may pose a risk to the community.

   We may also grant badges or other recognitions based on user activity and engagement within the app. Such badges are informational only and do not constitute any legal right, claim, or entitlement.

   You are solely responsible for the Content you create, upload, or publish through the Service, as well as for your interactions with other users. Shape is not responsible for disputes or legal consequences arising from user-generated Content.

4. Reporting Violative Content

   If you come across Content that violates these Terms, you can report it by contacting us at hello@appshape.io.

   We may review reported Content and take action at our discretion, but we are not obligated to monitor, remove, or respond to every report unless required by law.
   
   
   

5. License to Use Our Services

   We grant you a personal, non-exclusive, non-transferable, revocable, and limited license to access and use our Service for personal, non-commercial purposes, subject to these Terms.

   You may not:

   • Copy, modify, distribute, sell, or lease any part of our Service.

   • Reverse-engineer or attempt to extract the source code of our Service.

   • Use the Service for any unauthorized or illegal purposes.

   This license is automatically revoked if you violate these Terms. We reserve the right to suspend or terminate your access at any time.
   
   
   

6. Limitation of Liability
   
   

   • Shape is provided "as is" and "as available", without any express or implied warranties.

   • We do not guarantee that the Service will always be available, error-free, or uninterrupted.

   • To the maximum extent permitted by law, we are not responsible for:

     • Any loss of data, Content, or access to the Service.

     • Any harm resulting from interactions between users.

     • Any damages caused by third-party services, software failures, or unauthorized access to your account.

     • However, nothing in these Terms limits our liability where such limitation is not permitted by law, including in cases of gross negligence or where required by consumer protection laws.
       
       
       

7. Termination & Account Suspension

   We may suspend or terminate your access to Shape if:

   • You violate these Terms or any applicable laws.

   • We receive repeated reports about your activity.

   • You attempt to harm or disrupt the Service.

   If you wish to delete your account, you can do so in the app settings. Once deleted, your Content may no longer be recoverable, and we are not responsible for any data loss as a result of account deletion.
   
   
   

8. Changes to These Terms

   We may update these Terms from time to time. If we make significant changes, we will notify you through the Service or via email.

   By continuing to use Shape after the changes take effect, you agree to the updated Terms. If you do not agree with the new version, you should stop using the Service.
   
   
   

9. Governing Law & Jurisdiction

   These Terms are governed by the laws of Poland, without regard to its conflict of law principles.

   To the extent that these Terms allow for litigation in a court, both you and Shape consent to the exclusive jurisdiction of the courts of Poland. Any claims or disputes (whether contractual or otherwise) arising out of or relating to these Terms or your use of the Service will be litigated exclusively in Polish courts, unless this is prohibited by the laws of the country where you reside.

   If you are located in the European Economic Area (EEA), your rights under the General Data Protection Regulation (GDPR) and applicable national data protection laws also apply.

   If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
